End User Terms and Conditions

Unless otherwise indicated, Palgrave Connect and its contents are the property of Macmillan Publishers Limited, whose registered office is situated at Brunel Road, Houndmills, Basingstoke, Hampshire RG21 6XS ("Macmillan"). The copyright and all other intellectual property rights in the material contained on Palgrave Connect belong to Macmillan or its licensors. The trademarks appearing on Palgrave Connect are protected by the laws of England and international trademark laws.

Palgrave Connect is made available for the purposes of teaching, research and private study only, and access is subject to the license agreement your institution has signed with Macmillan. Please see our standard license agreement. These End User Terms and Conditions are intended as a guide to those elements of our standard license agreement that apply to end users of Palgrave Connect but do not in any way substitute for or replace your institution's license agreement which shall prevail in all cases. Your Institution's license agreement and these End User Terms and Conditions shall prevail in the event of any conflict between them and the Legal Notice generally applicable to use of this website.

Certain parts of Palgrave Connect are publicly available even when an institution does not have a site license or trial for all or any collections. If you are accessing Palgrave Connect on this basis you are NOT an Authorised User for the purposes of these End User Terms and Conditions and you have 'read only' access to the publicly available pages. Your use of Palgrave Connect is governed by the Legal Notice generally applicable to use of this website.

The following terms and conditions are extracted from our standard license agreement and outline what Authorised Users may or may not do when accessing Palgrave Connect.

For those Palgrave Connect Collections that your Institution has a site license for or is trialling, provided that you are an Authorised User you may:

  • access at any time via workstations located at your institution, Macmillan's server, or as the case may be any service provided by an agent on its behalf, for the purpose of accessing Palgrave Connect content for research, teaching, and private study purposes
  • print and/or download individual chapters and other individual items from searches of Palgrave Connect content, limited to no more than one chapter per title per Authorised User, (NB for material in data table format up to 12 tables per Authorised User) for research, teaching, and private study purposes by means of workstations located at your institution
  • use whatever recognised and reasonable means necessary to render accessible the Palgrave Connect content to those Authorised Users with a Disclosed Reading Impairment
  • reproduce a limited amount of Palgrave Connect content in printed hard copy and electronic course packs and study packs to be used in the course of instruction and/or in virtual and managed environments, but only with the prior written permission of Macmillan
  • create a hypertext link to any part of Palgrave Connect provided that no person other than an Authorised User may use such hypertext link.

Authorised Users may not:

  • sell, distribute, license, rent or otherwise exploit Palgrave Connect, or any element of it, for any commercial purpose
  • make Palgrave Connect, or any element of it, available by any means to persons other than Authorised Users
  • make Palgrave Connect, or any element of it, available on, or by, electronic bulletin boards, news groups, websites, FTP or any other means of posting or transmitting material on the Internet, an on-line service or wide area network
  • remove or obscure any copyright notices from Palgrave Connect, or any element of it, including any downloaded material whether in electronic format or hard-copy print-outs
  • use Palgrave Connect, or any element of it, to create any derivative work, product or service, or merge Palgrave Connect, or any element of it, with any other product, database, or service
  • alter, amend, modify, translate, or change Palgrave Connect or any element of it
  • undertake any activity that may have a damaging effect on Macmillan's ability to achieve revenue through selling and marketing any part of Palgrave Connect
  • otherwise use Palgrave Connect in a manner that would infringe the copyright or other proprietary rights contained within it
  • make Palgrave Connect or any part of it available by remote access to any person other than Authorised Users
  • make mass, automated or systematic extractions from or hard copy storage of any part of Palgrave Connect.

To apply for permission to re-use content on Palgrave Connect not covered by these End User Terms and Conditions, or your institution's license agreement, please email rights@palgrave.com.

Palgrave Connect and its content is provided for use "as is". Macmillan makes no warranties of any kind, either express or implied, including, but not limited to, warranties of satisfactory quality, accuracy or fitness for a particular purpose. Except as otherwise expressly provided in a license agreement with your institution, all conditions, warranties, terms, representations, and undertakings express or implied, statutory or otherwise in respect of Palgrave Connect and its content are to the fullest extent permitted by law expressly excluded. No oral or written information or advice given by any representative of the licensor or by anyone else shall create any warranties.

Macmillan does not warrant that access to Palgrave Connect will be free from errors or faults. In the event of a fault, please notify Customer Support of the same by telephone, electronic mail or in writing.

Macmillan is not responsible for the provision of or payment for the computer equipment and telecommunications services necessary for access to and use of Palgrave Connect. Macmillan shall not issue credits or refunds against charges incurred by you in relation to such telecommunication services or those incurred contacting Customer Support. You accept that Macmillan has no control over such telecommunication services and that Macmillan shall have no liability to you for the acts or omissions of providers of telecommunication services or for faults in or failures of their apparatus or of your or your institution's computer equipment.

The failure of either Macmillan or you to perform any of these end user terms and conditions as a result of conditions beyond its control such as, but not limited to, war, strikes, floods, governmental restrictions, power failures, or damage or destruction of any network facilities or services, shall not be deemed a breach of them.

Macmillan does not exclude or restrict liability for death or personal injury caused by its own negligence or any other liability the exclusion or limitation of which is prohibited by law.

In no event shall Macmillan or its employees, agents, suppliers, or contractors be liable for:

  • loss of profits, business, revenue, goodwill, anticipated savings; and/or
  • indirect, special, incidental or consequential loss or damage; and/or
  • any inaccuracy in Palgrave Connect.

Macmillan reserves the right to suspend a licensed or trialling institution's access to Palgrave Connect with immediate effect without liability if Macmillan reasonably believes Palgrave Connect or any of its content is being used by the institution or any Authorised User in a manner which contravenes the terms on which it is licensed. Further and additionally, Macmillan may terminate a licensed or trialling institution's access to Palgrave Connect for breach of these End User Terms and Conditions.

Macmillan is entitled to monitor the use of Palgrave Connect and its content through its servers, or as the case may be any service provided by an agent on its behalf, so as to monitor compliance with the applicable license agreement and these End User Terms and Conditions.

The content of Palgrave Connect is subject to change without notice, and you are advised that Macmillan has the right to terminate the supply of any part(s) of Palgrave Connect at any time without cause in accordance with the applicable license agreement in force with your institution.

On termination of the applicable license agreement in force with your institution, you must destroy all Palgrave Connect material stored on any digital information storage media, including, but not limited to, system servers, hard disks, diskettes, and back up tapes.

You have no rights, whether under the Contracts (Rights of Third Parties) 1999 or otherwise, to enforce or benefit from any term in any license agreement to which your institution is a party or by which it is bound at any time relating to Palgrave Connect.

Definitions

Authorised User
(a) every member of the teaching and research staff employed by or otherwise accredited to the licensed or trialling institution whether full-time or part-time (b) every student enrolled or accredited to the licensed or trialling institution for the purposes of full-time or part-time attendance (c) individual members of the public registered as users of the licensed or trialling institution's library or information service (d) individual members of the public permitted to use the licensed or trialling institution's library or information services; in each case who are permitted general access to the licensed or trialling institution's local area network.

Disclosed Reading Impairment
A reading impairment that has been disclosed by an Authorised User to the licensed or trialling institution and which prevents such Authorised User from being able to access Palgrave Connect or its content as supplied.
